Iguataxi Terms and Conditions

These Terms and Conditions govern the booking and provision of private transfer and personalised tour services offered by Iguataxi in the Puerto Iguazú region and the Triple Frontier. They constitute a binding agreement between the service provider and the client, and acceptance of these terms is a necessary condition for accessing the services offered.

Browsing the website iguataxi.com, requesting a quote, or confirming a booking by any means — including WhatsApp, email, web form or any other digital or verbal communication channel — constitutes full, express and unconditional acceptance of all the terms set out herein, in accordance with the applicable regulations on electronic contracting under Argentine law.

If the client does not agree with any of these terms, they must refrain from using the website and from booking any services, and contact Iguataxi to resolve any questions before proceeding.

2. Service Description

Iguataxi offers private transfer and personalised tour services for domestic and international tourists across the Triple Frontier region, covering Puerto Iguazú (Argentina), Foz do Iguaçu (Brazil) and Ciudad del Este (Paraguay). All transfers are carried out in private vehicles with a dedicated driver and are not shared with passengers outside the booking group, unless expressly agreed otherwise.

The service includes door-to-door transfer between the pickup and drop-off points agreed at the time of booking confirmation. Iguataxi does not guarantee continuous and uninterrupted availability of the website for booking management, as temporary interruptions may occur for technical or maintenance reasons or due to causes beyond the provider's control, without this giving rise to any liability on the part of Iguataxi.

3. Bookings and Service Confirmation

Bookings are made directly through Iguataxi's communication channels (WhatsApp, email or web form). A booking is considered duly perfected and binding on both parties once the following conditions are met:

  • The client expressly accepts the quote provided by Iguataxi.
  • For airport transfers, the client provides the relevant flight number.
  • A deposit is paid where applicable, as specified in the Payments section.

The client's booking confirmation, regardless of the channel used, carries full contractual effect under the applicable electronic contracting regulations. Iguataxi will send a confirmation through the same channel used by the client.

Iguataxi reserves the right to refuse or cancel a booking in duly justified exceptional circumstances, notifying the client immediately and at no charge, without this giving rise to any right to additional compensation.

4. Payments and Deposit

Advance deposit

A deposit equivalent to ten percent (10%) of the total service value is required only when the booking is made more than thirty (30) days before the transfer date. For bookings made within thirty (30) days of the service, no advance payment is required and the full amount is settled at the time of the transfer.

Accepted currencies and payment methods

Iguataxi accepts payments in Argentine pesos (ARS) and US dollars (USD). The applicable exchange rate will be agreed with the client at the time of confirming the booking or payment. Available payment methods are:

  • Cash (ARS or USD)
  • Bank transfer to an Iguataxi account
  • Credit or debit card, subject to an additional percentage surcharge due to local financial processing fees; the exact amount will be clearly communicated to the client prior to confirming this payment method

Iguataxi assumes no liability for delays, rejections or issues in the crediting of payments attributable to banks, payment processors, card networks or other financial intermediaries outside the provider's control. In such cases, the client must address any claim directly with the relevant entity.

Invoicing

Iguataxi issues a fiscal receipt upon express client request. Issuing a formal invoice may involve an additional charge, the amount of which will be clearly communicated and agreed with the client in advance. This surcharge is a result of tax obligations established under current Argentine fiscal regulations.

5. Cancellations and Modifications

Cancellation by the client

Clients may cancel their booking at no cost, provided they notify Iguataxi at least twenty-four (24) hours before the agreed date and time of the service through the available contact channels (WhatsApp or email). The notification must be received and acknowledged by Iguataxi in order to take effect.

No cancellation penalties apply when the notice period is respected. Iguataxi is committed to operating with flexibility and understanding in the face of unforeseen client circumstances.

Notwithstanding the above, Iguataxi reserves the right to review the conditions applicable to future bookings in cases of repeated cancellations without prior notice or conduct that is deemed abusive under applicable law. In such cases, Iguataxi may require additional confirmation conditions, without this constituting arbitrary discrimination against the client.

No-show

If the client fails to appear at the agreed pickup point and time without having communicated a cancellation, no additional charges will be applied beyond any deposit already paid where applicable. Iguataxi will attempt to contact the client through available means before marking the service as cancelled. The inability to reach the client shall not give rise to any liability for the provider.

Cancellation due to weather conditions

If adverse weather conditions prevent the safe delivery of the service, Iguataxi will attempt to arrange rescheduling for an alternative date. If rescheduling is not possible, the service will be cancelled without penalty for either party.

Booking modifications

Any changes to the transfer details (time, pickup location, destination, number of passengers) must be communicated to Iguataxi as early as possible. Modifications are subject to availability and may result in price adjustments, which will be communicated to the client in advance and will require their express acceptance to be valid.

6. Waiting Times

Iguataxi includes a waiting period of up to thirty (30) minutes at no additional charge from the agreed service start time, whether at the airport, hotel or any other pickup point.

For airport pickups, the waiting time is calculated from the actual landing time recorded by the flight tracking system, allowing a reasonable margin for the passenger to reach the arrivals area.

The client is obliged to keep their contact phone switched on, operational and accessible throughout the entire period corresponding to the booked service. If Iguataxi is unable to contact the client due to inactivity, lack of signal, a switched-off phone or any other cause attributable to the passenger, once the thirty (30) minute grace period has elapsed, this may be treated as a no-show, without giving rise to any liability for Iguataxi.

Any waiting time beyond the grace period will be assessed and agreed between both parties at the time, and may result in an additional charge depending on the circumstances.

7. International Border Crossings

Iguataxi carries out transfers to Brazil and Paraguay via the authorised border crossings of the Triple Frontier. The following conditions apply to these services:

  • The passenger is solely and exclusively responsible for holding valid, current and sufficient immigration documentation required for entry into the destination country (passport, visa, national identity document authorised for international crossings, sworn declarations or other documents required by the relevant immigration authorities).
  • Iguataxi does not provide immigration, customs or legal advice of any kind. Clients must verify documentation requirements with the competent authorities or qualified professionals before booking a border crossing service.
  • Iguataxi assumes no liability for immigration refusals, customs detentions, border crossing delays or any other situation arising from the passenger's documentation, immigration status, background or conduct before the authorities of any country involved.
  • Iguataxi shall not be liable for the loss of bookings at the destination, tourist activities, connecting flights, accommodation or any other financial or scheduling commitment of the passenger as a result of immigration or customs delays or incidents.
  • In the event of immigration difficulties, Iguataxi will endeavour to assist the passenger within its operational capacity, without assuming any legal, financial or joint liability for the situation or its consequences.
  • Waiting times at border crossings are outside Iguataxi's control and do not give rise to any liability for the provider.

8. Luggage

There is no strict luggage limit for Iguataxi transfers. The following conditions apply:

  • If the quantity or volume of luggage exceeds the cargo capacity of the assigned vehicle, an additional vehicle may be required. The associated cost will be communicated and agreed with the client before the transfer begins.
  • The transport of illegal items, hazardous materials, flammables, narcotics or any articles whose transport is prohibited under Argentine, Brazilian or Paraguayan law, as applicable to the service itinerary, is expressly forbidden.
  • The client is responsible for declaring any valuables or special equipment requiring particular care during the transfer, prior to the start of the service.
  • The client is responsible for checking, safeguarding and collecting all of their belongings upon completion of each transfer. Iguataxi assumes no liability for items left in the vehicle once the service has concluded, without prejudice to the reasonable efforts it may make to return them upon timely notification by the client.

9. Vehicles and Drivers

Iguataxi is committed to providing services with vehicles in appropriate safety, cleanliness and maintenance conditions. Should the originally assigned vehicle become unavailable due to technical issues or force majeure, Iguataxi may substitute it with another vehicle of a similar or equivalent category, notifying the client as early as possible. Such substitution shall not constitute a breach of contract.

Transfers may be carried out by drivers who are part of the Iguataxi team or by carefully selected third-party associated drivers, particularly for international transfers or operations that so require. In all cases, Iguataxi aims to ensure appropriate standards of conduct, road safety and knowledge of the operating area.

10. Force Majeure and Circumstances Beyond Iguataxi's Control

Iguataxi shall be exempt from liability for total or partial non-performance of the service when such non-performance is the direct consequence of a force majeure event or act of God, understood as any unforeseeable, unavoidable event beyond the provider's reasonable control, in accordance with the applicable provisions of Argentine civil law. The following circumstances are included on an illustrative and non-exhaustive basis:

  • Extreme weather conditions or meteorological events preventing safe travel
  • Road closures, blockages or interruptions to road access
  • Protests, demonstrations, strikes or civil unrest
  • Border closures by decision of the competent authorities of any country
  • Government orders, restrictions or prohibitions of any nature
  • Unforeseen mechanical vehicle failures not attributable to the provider's negligence
  • Traffic accidents caused by third parties
  • Pandemics, epidemics or public health emergencies declared by a competent authority
  • Any other unforeseeable and unavoidable event beyond Iguataxi's reasonable control

Upon the occurrence of any such event, Iguataxi undertakes to notify the client immediately through available means, to explore alternative solutions within its operational capacity and to agree on rescheduling or, where not feasible, cancellation of the service without penalty for either party.

11. Refunds

When a refund of a payment already made is warranted, Iguataxi will process it as soon as operationally possible, taking into account the processing timelines of each payment method. The refund will be made via the same payment method originally used by the client, unless both parties expressly agree otherwise.

Iguataxi assumes no liability for delays in the crediting of refunds attributable to banks, payment processors, card networks or other financial intermediaries. In such cases, crediting timelines are subject to the policies and operational schedules of those entities, over which Iguataxi has no control.

If the original payment method does not allow for a direct refund, both parties will agree on the most convenient alternative method.

12. Limitation of Liability

Iguataxi accepts responsibility for the proper delivery of the transfer service in accordance with the conditions agreed at the time of booking confirmation. Without prejudice to the non-waivable rights afforded to consumers under Argentine Consumer Protection Law 24.240, Iguataxi's liability is expressly limited as follows:

  • Iguataxi's maximum liability in respect of any claim arising from the provision of the service shall not exceed the total value of the service actually contracted and paid for by the client.
  • Iguataxi shall not be liable for indirect damages, consequential loss, lost profits, loss of opportunity, loss of bookings at the destination, activity cancellations, missed connecting flights or any other consequential loss arising from the delivery, delay or cancellation of the service.
  • Iguataxi assumes no liability for damage to, loss of or theft of personal items or luggage not declared prior to the start of the transfer.
  • Iguataxi shall not be liable for delays attributable to customs, immigration or security checks, nor for losses of passenger commitments resulting from force majeure events or circumstances beyond the provider's control.
  • Iguataxi does not guarantee continuous and uninterrupted availability of the website iguataxi.com. Temporary interruptions for technical, maintenance or external reasons shall not give rise to any liability for the provider.

13. Passenger Conduct

The client and all passengers in their group agree to behave appropriately throughout the transfer, following the driver's instructions and complying with applicable road safety, traffic and coexistence regulations.

Iguataxi reserves the right to refuse to begin the service or to terminate it at any point if any passenger's conduct poses a risk to the physical integrity of any person, the safety of the vehicle, or violates applicable law. In such cases, no refund shall be issued for the portion of the service not delivered, without prejudice to any legal action that may be taken in respect of damage caused to the vehicle or to the driver.

The consumption of alcohol, narcotics or any prohibited substance inside the vehicle during the transfer is expressly forbidden. Breach of this prohibition will entitle Iguataxi to immediately terminate the service under the conditions described in the preceding paragraph.

14. Modifications to These Terms and Conditions

Iguataxi reserves the right to modify these Terms and Conditions at any time in order to adapt them to operational, regulatory or service changes. Modifications will take effect upon their publication on the website iguataxi.com. Booking a service after such publication constitutes full acceptance of the updated terms.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed in their entirety by the laws of the Argentine Republic, in particular the Civil and Commercial Code of the Nation, Consumer Protection Law 24.240 and its supplementary regulations, and the specific regulations applicable to the transport of persons.

For the resolution of any dispute arising from the interpretation, performance or breach of these Terms and Conditions, the parties submit to the exclusive jurisdiction of the Ordinary Courts of the Province of Misiones, Argentine Republic, expressly waiving any other jurisdiction that may apply, unless mandatory legal provisions provide otherwise.

The provisions of this clause do not affect the consumer rights recognised under Law 24.240 and related regulations, which are non-waivable under Argentine law.
